An example of what can happen when intellectual property rights are not properly protected is the now ubiquitous fidget spinner.
Had the inventor of that product come to us at the early stages of its life (most importantly, before details of the product had been published), we would have advised them to obtain a patent covering the function of the product, registered designs covering the appearance of the product and a registered trade mark, to protect the name FIDGET SPINNER.
We would have drafted the patent application, filed it with the authorities and shepherded it through the patenting process, including extending protection for the patent in key territories abroad. We would also have filed registered design applications in key territories and would have registered the trade mark FIDGET SPINNER, before it became a generic term, in every country where the product was likely to be sold.
These elements would have built a strong monopoly around the product and would have ensured that the inventor or their company, and their chosen licensees, were the only organisations who could sell the FIDGET SPINNER toy.
Although there is a cost associated with putting in place quality patent, registered design and trade mark protection, had the inventor achieved the exclusivity those rights would have conferred, the costs would have been recouped extremely quickly, given the overwhelming popularity of the product.
